Cadastral valuation turnaround

The progressive increase of property taxes by adjustment of cadastral value and cancellation of tax benefits makes think of verifying the established cadastral value.


The judicial method of so-called "revaluation" of cadastral value is well-known. If in 2011 the cadastral value was successfully "contested" in arbitration courts, and it was even possible to recover legal costs for a representative and expert examination from Rosreestr, at present a mandatory pre-trial departmental procedure has been introduced, the results of which are extremely difficult to overturn in a court of general jurisdiction.


Currently, there is a brand new and effective approach. It is appropriate to refer directly to the report on the basis of which information on the cadastral value of the facility was entered, since the state cadastral valuation is carried out solely on the basis of data generated and provided by Rosreestr, without taking into account all additional information that, no doubt, affects the final result under the applicable methodology. Errors in determination of the cadastral value are often caused precisely by the lack of correct data (discrepancies in technical documentation, failure of the former to not provide information to the Technical Inventory Bureau, reconstruction and/or change of purpose of the premises, or land category, etc.). In this case, a special procedure for correcting errors through qualified updating of information is applicable, meaning there will be no need to contact either the commission or the court. In case of deliberate unjustified rejection to correct data and/or cadastral value – and only then – it will be required to resort to judicial defense, but such cases are exceptional.


In order to apply the cadastral value amended in this way for taxation, the regulatory procedure involving a lawyer and an appraiser must be initiated and completed in the current year. On average, it takes up to three months from the moment the request is processed, both for the project and for the approved report.
